  1. Terms
    1. These are the terms and conditions on which My Flower School (“we”, “us” or “MFS”) provides flower courses to you (“Course Terms”). Please read these Course Terms carefully before booking a course. By booking a course through our website, by email, by telephone or by any other method, you agree to be bound by these Course Terms.
  2. Information about us
    1. My Flower School Pty Ltd is a proprietary limited company incorporated and registered in Queensland, Australia. Our address is 180 Main Street, Kangaroo Point QLD 4169. Our company registration number is 696 050 398, and our ABN is 34 696 050 398.

  3. Our contract with you
    1. The information shown to you as part of the booking process, these Course Terms and, if you book online, the Website Terms of Use comprise the legally binding contract between you and My Flower School (“the Contract”).
    2. After making your booking, you will be sent an email detailing your booking (“Confirmation Email”). Your place on the course is confirmed once the Confirmation Email has been sent. The Contract will only be formed when you have been sent the Confirmation Email.
    3. Please ensure that you provide us with a correct email address, as this is how we will communicate with you about your booking. Upon receiving the Confirmation Email, please check the details for accuracy and let us know immediately if there are any errors.
    4. You must be at least eighteen years old at the time of booking to attend a course, unless you are accompanied by a supervising adult. You must also have a sufficient level of English, as all our courses are conducted in English.
    5. Please note that the teachers for each course may vary, and we do not guarantee a particular teacher or that specific items will be produced during any course. All images on the website are for reference purposes only.
  4. Fees and payment
    1. All fees must be paid in full at the time of booking to secure your place. All stated fees include GST at the prevailing rate.
    2. We accept payment of fees online by credit card or debit card. If you wish to pay by bank transfer, you should contact us by email before making a booking.
    3. All materials and flowers are included in the course fees.
    4. While we will try to ensure that all prices on our website are accurate, errors may occur. We will normally verify prices as part of the booking process. If a course you have booked is listed at an incorrect price due to a typographical or administrative error, we will notify you of the correct price, and you will have the option of cancelling your booking.
  5. Gift vouchers
    1. Open gift vouchers are valid for one year. Courses must be booked within that period, although the course date or course start date (“Course Date”) may fall after the voucher’s expiry date.
    2. When booking a voucher for a specific course, you will be required to provide the name and contact details of the person attending the course, along with details of any special instructions or specific needs. Before the Course Date, an email will be sent to the voucher recipient using the contact details provided. The email will include details of the course and a copy of these Course Terms. The voucher recipient will be asked to confirm their agreement to these Course Terms. If the recipient does not provide this confirmation, we will be entitled to refuse their attendance. The recipient must be at least eighteen years old at the time of attending the course. As our courses are taught in English, each student must be proficient in English.
  6. Non-Australian residents
    1. Please provide contact details for your stay in Australia when making your booking in case we need to contact you before the course commences.
    2. Please ensure that your booking is confirmed and that the course is proceeding before making any travel arrangements. We cannot offer refunds for travel or accommodation costs.
    3. If you do not hold an Australian passport, you may require a visa that permits you to enter Australia to attend one of our courses. For more information, please visit the Australian Department of Home Affairs website: https://immi.homeaffairs.gov.au/. It is your responsibility to determine whether a visa is required, how far in advance you need to apply and whether you have allowed sufficient time to obtain it.
    4. If you are refused entry to Australia, you will not be eligible for a refund of the course fees.
    5. If your visa is delayed, you will also not be eligible for a refund of the course fees. However, at our discretion, we may consider transferring you to another course at a later date.
    6. We require a copy of your passport and visa at least five working days before the course commences. We will not allow you to join the course if you do not have the documentation required to enter Australia. An electronic copy is sufficient to confirm your place on the course. Please email us the required documentation.
  7. Allergies and specific needs
    1. We will try to adapt our courses to accommodate an individual’s allergies and specific needs. However, this may not be possible for every course. To determine whether a course can be adapted and to what extent, you should contact us by email before making a booking.
    2. You must provide details of any allergies or specific needs as part of the booking process.
    3. All requests for course adaptations to accommodate specific needs must be made by email at least one week before the Course Date. Failure to do so may result in us refusing to allow you to attend the course.
  8. Course transfers
    1. We will do our best to accommodate requests to transfer to another course, but all transfers are at our discretion and subject to availability.
    2. Students may not transfer to another course once their course has commenced.
  9. Your cancelation rights
    1. Once you have booked a course, you cannot cancel the Contract unless you have statutory cancellation rights under clause 9.2. However, if you are unable to attend the booked course, please contact us by email or telephone. We will credit the fees you have paid towards another course, subject to availability, provided that you book the alternative course at the same time.
    2. Nothing in these Course Terms affects your statutory rights as a consumer to cancel your booking within 14 days of the booking date, provided that the course has not been completed, by notifying us by post or email. In these circumstances, My Flower School will refund all fees paid within 14 days of receiving your cancellation. However, if you have started attending the course, we will be entitled to charge you for the services provided before your cancellation.
  10. Our cancelation rights
    1. Please note that courses have minimum attendance requirements and may be cancelled if too few bookings are received. We reserve the right to amend or cancel courses.
    2. If we cancel a course, we will endeavour to give you at least one week’s notice. You will have the option of transferring to another course or receiving a full refund of the fees. We will not be liable for any losses, including but not limited to travel and accommodation costs, arising from any modification or cancellation of a course or from the timetabling constraints described above, beyond the cost of the course fee.
    3. We may also end the Contract at any time by email, and we will not be required to refund the fees you have paid in such circumstances, if: (a) you do not make a payment to us when it is due; (b) you cease attending the course, other than following a permitted cancellation as set out above; (c) your behaviour does not comply with our standard rules and procedures; (d) at any time, including when booking, you provide us with information that is inaccurate, incomplete or misleading, or fail to provide information requested by us that may affect your ability to complete the course; or (e) during the course, you develop a medical condition or take medication that creates a barrier to learning, and making the adjustments required to accommodate you safely would cause us to incur additional time or expense that would be unreasonable in the circumstances.
    4. We will be entitled to cancel any course or any part of a course at any time due to circumstances or events beyond our reasonable control or for any other reason. In such circumstances, we will reimburse the fees you have paid in respect of the course or the part of the course that has been cancelled. Alternatively, if you choose, we will credit the fees you have paid towards another course. You acknowledge that we will have no other liability to you for any loss or damage you may suffer as a result of the cancellation.
  11. Our liability
    1. If you are a consumer, you have legal rights in relation to services that are not provided with reasonable skill and care. Nothing in these Course Terms will affect those legal rights.
    2. We do not exclude or limit our liability to you for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors, for fraud or fraudulent misrepresentation, or for a breach of any of your legal rights in relation to our services.
    3. We will not be liable to you if we are prevented or delayed from complying with our obligations under these Course Terms due to anything you, or anyone acting on your behalf, does or fails to do, or due to events beyond our reasonable control.
    4. We are only responsible for losses that are a natural and foreseeable consequence of our breach of the Contract or our failure to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is obvious that it will happen or if, at the time the Contract was made, both you and we knew that it might happen. For example, this may apply if you discussed the potential loss or damage with us during the booking process.
    5. In any event, we will not be liable for any losses related to any business of yours, including, without limitation, lost data, lost profits, lost revenue, lost business opportunities or business interruption.
    6. We will not be liable for any allergic reactions caused by flowers or other materials used in arrangements, or for any staining or discolouration caused by the arrangements, unless you instructed us not to use particular flowers or materials or, in the case of an allergic reaction, the reaction was caused by our negligence.
    7. In addition to the above and subject to clause 11.2, if you are a business client: (a) we will not be liable to you, whether in contract, tort, including negligence, breach of statutory duty or otherwise, for any loss of profit or any indirect or consequential loss arising under or in connection with the Contract between us; and (b) our total liability to you for all other losses arising under or in connection with the Contract between us, whether in contract, tort, including negligence, breach of statutory duty or otherwise, will be limited to the fees you have paid under the Contract.
  12. How we may use your personal information
    1. We will process the personal information you provide to us in accordance with our Privacy Policy.
  13. Photographs and videos
    1. Photographs and videos may be taken from time to time of students during their flower courses. These photographs and videos may be used in our marketing materials or on our social media channels. Please let us know if you do not wish to appear in any photographs or videos. We will always respect your decision not to be featured.
    2. If you take photographs or video footage of your work and post them on social media, please credit us by using the hashtags #myflowerschool and #myflowerschoolaustralia and tagging the school account, @myflowerschool.
  14. Health and safety
    1. Students are expected to follow the health and safety guidelines provided at the start of each course.
    2. Students must wear appropriate clothing and footwear during the course. To ensure your safety, non-slip, closed-toe shoes must be worn to all classes. Thongs, open-toed footwear and high heels are not permitted in the classrooms. While all reasonable care is taken, you are responsible for your own safety and property when travelling to and attending a course at My Flower School.
    3. Any student who fails to comply with our health and safety guidelines will be unable to participate in the course and will not receive a refund of the course fees.
  15. Intellectual property rights
    1. All intellectual property rights and other ownership rights in all documentation, flowers, arrangements, materials, designs, creative concepts, logos and branding, in whatever form, relating in any way to our courses or your participation in them belong to My Flower School. These items may not be copied, distributed or used by you without our prior written consent.
    2. At the end of a course, a student will usually be permitted to take away any specific item they have created as part of that course, but this is at our sole discretion.
  16. General
    1. Each provision of these Course Terms operates separately. If any court or relevant authority decides that a provision is unlawful, invalid or otherwise unenforceable, that provision will be deemed severed from the remaining provisions, which will continue in full force and effect.
    2. Even if we delay enforcing the Contract, we may still enforce it later. For example, if you fail to make a payment and we do not pursue it immediately but continue to provide the course, we may still require you to make the payment at a later date.
    3. Termination of the Contract will not extinguish any claim that has already arisen.
    4. You may not transfer any of your rights under the Contract to another person without our written permission.
    5. The Contract is governed by Australian law, and the Australian courts will have exclusive jurisdiction over any claim arising from or relating to the Contract, our courses, these Course Terms or your participation in any course.
